By purchasing products or services from Fresh Hibiscus LLC, including its brands Fresh Hibiscus Ambitious and Fresh Hibiscus Publishing (collectively referred to as “we,” “our,” or “us”), you (“customer,” “you”) agree to the following terms and conditions:
Services and Products
We provide a range of digital products (including but not limited to templates, guides, and checklists), email consultation services, online consultation sessions, online training courses, and live or recorded events, workshops, and study groups (collectively, “Events”). You understand and acknowledge that our services, Events, and materials are provided for informational and advisory purposes only. They do not constitute, and should not be used as a substitute for, legal, tax, medical, immigration, or other professional advice.
Our services may utilize Artificial Intelligence (AI) to provide information. We do not guarantee the accuracy of AI-generated content, and such content is provided for informational purposes only. Use of AI-generated information is at your own risk.
Payment and Pricing
All prices for our products, services, and Events are listed in USD.
Accepted Payment Methods: Payments may be processed via Payhip, Stripe, or other mutually agreed-upon methods. Supported payment options include Credit Cards (including JCB), Amazon Pay, Apple Pay, Google Pay, Cash App Pay, ACH Direct Debit, and Cryptocurrency.
Responsibility: You are responsible for ensuring timely payment and for any applicable taxes, bank fees, or transaction charges associated with your chosen payment method.
Refunds and Cancellations
Due to the digital nature of our products and the time-intensive nature of our services and Events, refunds are not generally provided once access is granted, a session is completed, or an Event has commenced.
Consultation Sessions: Cancellations or rescheduling requests must be made at least 24 hours in advance of the scheduled time.
- Events and Workshops: Registration fees for Events are generally non-refundable. However, if we cancel an Event, a full refund or credit for a future Event will be provided.
- Discretionary Refunds & Fees: Any refund requests will be reviewed on a case-by-case basis and may be granted at our sole and absolute discretion. Please note that for any approved refund, third-party processing fees (typically ranging from 1.5% to 6%) are non-refundable as they are retained by the payment service providers (e.g., Stripe, Amazon). Any refund will be issued for the net amount (the original price minus these fees).
Intellectual Property and Event Recording
All content, materials, frameworks, strategies, and templates provided through our services and Events are the exclusive property of Fresh Hibiscus LLC.
- Limited License: Customers are granted a non-exclusive, non-transferable license for personal or internal business purposes only. Redistribution or resale is strictly prohibited.
- Event Recording: We may record our Events for future educational or promotional use. By participating in an Event, you acknowledge that your voice or likeness may be recorded. If you do not wish to be recorded, please keep your camera and microphone turned off during the session.
Limitation of Liability
To the maximum extent permitted by applicable law, Fresh Hibiscus LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of, or inability to use, our products, services, or Events. You assume full responsibility for your decisions and actions based on the information provided.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, USA. Any legal action or proceeding related to these Terms shall be brought exclusively in the appropriate state or federal courts located in California.
Confidentiality
During the course of providing services or Events, both parties may have access to “Confidential Information.”
Our Confidential Information: All materials, proprietary methods, and techniques used by us are Confidential Information belonging to us. You agree not to disclose, distribute, or otherwise make them available to any third party.
Client Confidentiality: We agree to maintain the confidentiality of any non-public personal or business information you provide, except as required by law, to comply with legal or regulatory obligations, or as reasonably necessary to perform the contracted services.
Relationship of the Parties
The relationship between us and you shall be that of independent contractor and client. Nothing in these Terms shall be construed as creating a partnership, joint venture, employment, fiduciary, or agency relationship.
Term and Termination
We reserve the right to immediately terminate or suspend your access to our services, products, Events, or training platforms, without refund, if you breach these Terms of Service, including but not limited to non-payment, violation of intellectual property rights, or disruptive or abusive behavior.
Entire Agreement and Precedence
These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and us with respect to the subject matter herein. In the event of a conflict, the terms of a specific signed service agreement shall take precedence over these Terms.
